Project Details:
i. Project
: National Population Register (NPR 57 Crore).
ii. RFQ-Ref : ITI/CPSU/NPR57/CORORE/SE, Dt: 1st Oct'2010.
iii. Scope
: The project of NPR has a scope of covering the 57 crore population in 9 Costal
States of Gujarat, Maharashtra, Goa,Karnataka, Kerala, Tamilnadu, Andhra Pradesh,
Orissa, West Bengal,NCT of Delhi and UT of Puducherry for Setting up of Data Entry
Centers, Bulk Bilingual Data Entry of Usual Residents, Biometric Data Enrolment
(Photo, Finger Print and IRIS of both eyes) and Printing of LRUR (Local Register of
Usual Residents).
iv. Agency
: Consortium of Public Sector Undertakings (CPSU) comprised of Bharat Electronics
Limited (BEL), Lead Partner, Electronics Corporation of India Limited (ECIL) and Indian
Telephone Industries (ITI) for the Office of Register General of India (ORGI).
v. Launch
: Project officially launched on 20th May'2011
Purpose of the Document:
i. This is to bring to notice of any concerned regarding suffering of the Nation and its people because
of the immature decisions and actions of a handful people at the highest levels. What is being
brought to light is the large deviations to National Population Register (NPR) which is the
Enrollment process in turn forming the basis for the UID - `Aadhar' to be issued by the Unique
Identity Document Authority of India (UIDAI).
ii. The intent is to blow a whistle in drawing attention to the gross loss of time, effort, resources and
money to the Nation and its cascading effects.
iii. The expectation is an in-depth and transparent inquiry/ evaluation of the facts/ issues detailed in
the documents hereafter.
Our Experience:
i. We had been associated in the NPR project in its 1st phase - the NPR-Coastal and with the
experiences gained/ lessons learnt, had compiled a case study and circulated to all the stake
holders.
ii. We are also one of the successful bidders and were offered 1 Crore population enumeration in the
State of Maharashtra for Rs. 18 Crores against our quote of Rs. 26 Crores.
iii. Upon receiving the offer, we had inquired the CPSU on how to execute the project at such unviable
rates, to which their officials responded by saying that, when you can get operators for Rs.1500/-,
be smart in finding ways around and not compliance to terms & conditions. This response had
created unspeakable concerns and we found it prudent to decline.
iv. However during the entire process of the tendering, before and after it, we had the opportunity to
closely understand and experience the unprofessional and unethical manner the project was being
executed.

It still comes as a rude shock when we recollect the meeting with the members of a PSU - BEL at
Banglore in the month of Feb'11, where in the due course of discussions there was an attempt to
intimidate us stating - "This project belongs to Mr. Chidambaram and hope you know who he is - all
your attempts are insignificant and in vain" and "Trying to fight with us (the CPSU) is like banging your
head to a mountain - it makes no difference to the mountain whereas you will bleed enough".
We held onto our beliefs; in doing a quality job, fighting for justice and in our countries value systems,
but have been proven wrong.
What we have learnt instead is that may be these quotes are true "Government is big business, with
the face of Democracy."--Jim West and to facilitate this the CPSU has done good to "Failing to plan
is planning to Fail."--Winston Churchill.
The most amazing blueprint `Aadhar' in projecting the country into the next spiral of growth by giving
identity to its citizens, the design of using the Census digital data base the National Population Register
(NPR) as the part of enrollment process, is in the process of a complete failure in its program
objectives.
We had made our best efforts to reach to the bottom of this by officially enquiring (both as a company
and as individual) and received the responses as;
1) The ORGI said that the project ownership lies with CPSU chaired by BEL, hence they will respond.
2) The BEL initially declined responding, but upon the directions of the AA in our RTI-application, said
the ITI is the tendering authority and they will respond.
3) The ITI said all the information asked by us is confidential in nature and as against clause 8.1.d of
the RTI-Act, they need not respond.
4) The ECIL, did not even care to acknowledge to our queries, much less respond.
5) The CIC-New Delhi, completely ignored our written submissions and conveniently accepted the
mis-guidance of the BEL representative and ruled that by this time we must have already received
all the information.
If the most respected PSUs - BEL, ECIL and ITI, which form the CPSU, conduct themselves with such
blatant irresponsibility and plagiarism, what confidence can we get regarding transparency and justice
and the success of the project.
So, will the country and we as citizens, ever know what is happening before too long or will it turn to be
another scam. The following are the mysterious unanswered, which are indicators for such impending
derailment;
1) By not awarding the contract to M/s Jyothi computers at Rs.17.94/- (Inclusive of Tax) and rather
awarding the contracts at Rs. 17.94/- (Exclusive of Tax) onwards and later enhancing the rate to
Rs. 23.19/- - why is the government suffering a difference of Rs.7.10/- which is to say a difference
of Rs.405 Crores. Because they are PSUs, can't such glaring violations be questioned?

2) A company called the Swiss Tech NPR 57Cr Project Private Limited (the name itself indicating its
creation for a fly-by-night operation), which has been incorporated on the 27-10-2011, which is to
say that it did not exist on the date of the submission of the bids which is 28-10-2010 has been
awarded 5 Crore population enumeration which is approximately Rs.116 Crores. Who is the
beneficiary of these amounts?
3) The M/s Madras Security Printers Pvt. Ltd. had been black listed for the year 2011-12 by the UIDAI
for violation of terms and conditions of enrollment process and same was intimated to the ORGI,
however the MSP was still awarded 9 Crore population enumeration which is approximately Rs.210
Crores (because of its very strong political high-hand), allowing the risk of the 9 Crore population
enumeration and the associated rework costs, time and effort of the government machinery. Is the
CPSU above the law & system to go unchecked for disregarding such clear communication?
4) The One District Projects (approximating a Crore of population taken out of the 57Cr population
Project) was awarded on a limited tender to the earlier participated Service providers at
Approximately Rs. 29/-, which is running parallel to the NPR-57Cr. The difference of approximately
Rs.12/- to that of the NPR L1 rate, which amounts to approximately Rs.12 Crores. Was this just
to facilitate goodwill and collusion between the Service Providers and CPSU?
5) A total of approximately 40,000+ personnel (operators & staff), who are employed for the
enumeration process, are to be paid Minimum wages + PF + ESI of Rs.8,561/- as has been
stipulated in the tender, but majority are not even getting the BPL rate of Rs 32 per day, which is
forcing them to resort to illegal collections from the citizens, which has even been reported in the
print media many times. For how long will the work force of India be the slave-machinery?
6) It may be understood that the very intention of assigning the project to the CPSU was to ensure the
sanctity, data security and citizen convenience. However the entire project is further outsourced in
bits & pieces against the primary tender conditions and all the infrastructure requirements have
been grossly compromised resulting into an estimated approximate Rs. 2 Crores per every 1 Crore
population enumeration totaling to Rs.114/- Crores being allowed as illegal benefits, to the service
providers due to the non-enforcement by the CPSU. Are the Tender condition violations desired
by the CPSU for ulterior appeasements?
7) The CPSU originally arrived at a baseline price of Rs.24/- but for reasons best known/ unknown
they had reduced it arbitrarily by 30% to bring it down to Rs.17/- plus. However in recent times with
an insignificant scope change as an excuse, made an increase of 600% to an item (from Rs.0.75/-
to Rs.5.25/-) and enhanced the rate to the same approximately Rs.24/- resulting into approximately
Rs.300 Crores. This clearly goes on to show that the CPSU with the intent of favoring certain
Service providers had pre-planned and conspired to bring down the quote process to an
unreasonably/ unimaginably low and eliminate realistic quotes and later once the works began
enhanced the rates to the evaluated viable. Is this how, blatant mistakes of estimations are
corrected?

8) In the evaluation process, the CPSU apart from playing the baseline price/ unduly low - card, had
also played other cards in that they have completely rigged the award of contract process. This is to
say that the actual L1s have been conveniently sidelined (probably declaring them as below
baseline, though they are NOT) to give legality to the next higher rates of L2/ L3 by which the
preferred service providers have gained the benefit of getting the desired centers at their highest
quoted rates and at desired locations. This has led to a difference amount of approximately
Rs.0.50/- per enumeration which results into approximately Rs.1 to 5 Crore for the Service
Provider, totaling to Rs.14 Crore (MH-5 Cr, TN-4.2 Cr, KA-3.6 Cr & OR-1 Cr) loss to the
Government. Is this re-defining kick-back channels?
9) Apart from the above there are many more such glaring violations in the evaluation, operations and
compliance - which have been categorized project phase wise as a comprehensive list.

1) Because they are PSUs, can't such glaring violations be questioned?
a) M/s Jyothi Computers, having its Registered office at 3-4-496/ A, Jyothi Arcade, Barkatpura,
Hyderabad, Andhra Pradesh-500027, has been the lowest bidder for the State of Andhra
Pradesh at Rs.17.94 (Inclusive of Tax)/-
b) However by adopting the Baseline price at Rs. 17.10/- M/s Jyothi Computers had been
disqualified as unduly low rate.
c) M/s Jyothi Computers had appealed in the High Court of Andhra Pradesh vide WP-1454 of
2011 and had received a Judgment Dt: 16-03-2011, in their favor stating ..... The State cannot
be burdened with unnecessary expenditure by rejecting the lowest bid made by an
agency, which was found to be technically and otherwise qualified. ...... The respondents
1 to 3 are directed to consider the matter afresh, without reference to the "cut off rates". It shall,
however, be open to them to invoke Clause 15.15, vis-a-vis the petitioner, and if they choose to
do so, they shall be under obligation to give an opportunity to the petitioner to explain, as to
how the rates quoted by it are workable.
d) The CPSU had then invited M/s Jyothi computers for explanation regarding the workability of
the quoted rate. Whether the discussions were either arm-twisted or schemed is for any one to
guess, when M/s Jyothi computers withdrew from the project citing some very lame reasons.
e) The next lowest bidder M/s Pioneer E-Labs at Rs. 16.99/- was not considered for reasons
completely unknown.
f) The project was awarded then awarded to the 3rd lowest M/s Swiss Tech India Pvt. Ltd. at Rs.
17.94/- (Exclusive of Tax).
g) Of the 3 items Demographic data entry, Biometric enrollment and LRUR printing, the quoted
rate for LRUR printing (which was at an average) Rs.0.75/- was enhanced by 600% to Rs.
5.25/- stating that the printouts are to be printed at sites instead of centralized location, whereas
the tender very specifically states regarding no price escalation.
h) In this entire mis-allotment and unjustified rate enhancement the government is suffering a
difference of Rs.7.10/- which is totaling to an approximate of Rs.405 Crores.

2) Who is the beneficiary of these amounts?
a) Tentative Offers with Ref.No.s - ITI/ CPSU/ NPR57CRORE/ LOI/ 13 A, Dt: 11-01-2011, were
issued to M/s Swiss Tech India Pvt. Ltd. for 7 Crore population enumeration (4 at A.P, 1 at
Delhi and 2 at MH).
b) After M/s Jyothi computers submitted its withdrawal from the tender on 2-4-2011, a stupendous
scheme was hatched by the CPSU, M/s Jyothi computers and M/s Swiss Tech India Pvt. Ltd.
c) A company by the name Swiss Tech NPR 57Cr Project Private Limited had been incorporated
on the 27-10-2011.
d) This new company has its directors who are the stakeholders in M/s Jyothi computers and with
its Registered office at 3-4-496/ A, Jyothi Arcade, Barkatpura, Hyderabad, Andhra Pradesh-
500027 which is M/s Jyothi computers Registered office.
e) Prestigious multinational companies like the WIPRO, State owned company like the KELTRON
had been disqualified at the eligibility stage itself, contrarily this new company which did not
even participate in the bid (as it did not exist by then - 28-10-2010) and which does not fulfill
any of the eligibility conditions, including even the turnover/ net-wroth requirement of 50 Crores

awarded 5 Crore population enumeration which is approximately Rs.116 Crores.

3) Is the CPSU above the law & system to go unchecked for disregarding such clear
communication?
a) In a communication vide Ltr. No. 4(4)/ 57/ 66/ 2011-RoB, Dt : 23rd Aug'2011, the Asst. Director
General, RoB Division, UIDAI, Planning Commission, Government of India had stated that ...in
view of violation of terms and conditions of empanelment by the said agency, it has been
decided not to renew the empanelment of M/s Madras Security Printers Pvt. Ltd. as an
enrolment agency under the UID project ....
b) However company like M/s Madras Security Printers Pvt. Ltd. and its group company M/s Eagle
Software India Pvt. Ltd., because of its their strong political high-hand, went unscathed.
c) The CPSU had knowingly and blindly (with no additional checks and balances), awarded 9
Crore population enumeration which is approximately Rs.210 Crores and another 8 Crore
population enumeration which is approximately Rs.187 Crores to its group company too.

4) Was this just to facilitate goodwill and collusion between the Service Providers and CPSU?
a) The National Population Register (NPR 57 Crore) - for 57 Crore Population Enumeration
Project, vide RFQ-Ref : ITI/CPSU/NPR57/CORORE/SE, was released on the 1st Oct'2010.
b) The National Population Register - In One District - for 1 District in each of the states under the
NPR 57 Crore project, vide RFQ-Ref : ITI/NPR/NGO/GO, was released on the 5th Oct'2010,
and for Other States.
c) This One District project for approximately 1 Crore Population enumeration was taken out of the
already released tender for the 57 Crore population enumeration.
d) The tender was made Limited in nature and was circulated to the earlier participated Service
Providers of the `Creation of National Population Register (NPR) in Costal Villages'.
e) The NPR in its earliest stage of MNIC as Proof of concept, later on as Pilot in 10 districts and
then as NPR in Costal Villages, had completed its different stages of viability and other such
study/ assessment requirement.
f) The need for taking out 1 Crore population out of the declared National Tender and allotting it to
limited service providers and allowing it to run parallel to the NPR-57Cr, remains unexplained
and un-understandable.
g) What surprises the fact is that for a work which is of identical nature the NPR One District and
NPR 57 Crore, for the NPR One District the rate awarded was at approximately Rs. 29/-, with a
difference of Rs. 12 to that of the NPR L1 rate, which amounts to approximately Rs.12 Crores.

5) For how long will the work force of India be the slave-machinery?
a) The Number of personnel employed Vs Productivity so far is not matching, which is to indicate
that the Service Providers are under-employing and over burdening the operators.
b) The 2-shift operations as stipulated are not being conformed to and each of the shifts is over
and above the labor regulations of 8hrs.
c) As per the terms and conditions stipulated in the tender, the Minimum wages + PF + ESI of
Rs.8,561/- is to be paid to the operators.
d) However, majority of the operators are not even getting the BPL rate of Rs 32 per day, which
is forcing them to resort to illegal collections from the citizens, which has even been reported in
the print media many times.
e) Surprisingly So far not even 10% of the employees have been issued PF-Codes and most of
the service providers are not even registered for ESI.
f) The CPSU is not enforcing the same (through the regular practice adopted by all such Principal
Employers) by asking them to submit the copy of Wage Registers, PF returns and ESI challans
along with the invoice before release of payments.
g) Though the Government takes pride in creating employment in the country, a total of
approximately 40,000+ personnel (operators & staff) in this project, and similarly in other
projects of the CPSU as Creation of National Population Register (NPR) in Costal Villages,
RFQ-Ref: ITI/CPSU/NPR/2009/S01, Dt: 25.05.2009 and Creation of Marine Fishers Database,
RFQ-Ref: ITI/CPSU/MFD/2010/S01, Dt: 08.06.2010, suffer the same fate.
h) Upon inquiring regarding relevant data through the RTI and even after the directions of the AA,
M/s BEL conveniently and irresponsibly responded by saying that `it is in the vendors scope
and not available with BEL'.

6) Are the Tender condition violations desired by the CPSU for ulterior appeasements?
a) The entire project is further outsourced in bits & pieces by every Service Provider at a margin of
Rs.2/- to 5/- on the work order rate of Rs. 17.10/-, against the primary tender conditions and the
operations no longer seem to be of a National Project but are as if roadside Internet cafes/
DTP-centers.
b) The Data Security related infrastructure of Biometric Access, CC-TV Surveillance, etc to
provide a Level-4 security setup, is completely compromised by every Service Provider.
c) The infrastructure setup for the Data Entry Centers with respect to the Space, Furniture and
Facilities, Hardware as per configuration, Uninterrupted power, Ambient environment, etc are
all un-provided
d) The infrastructure for the Biometric enrollment operations in the field in terms of power at
remote locations, logistics, space and setup arrangement, accommodation for personnel and
resources requirements like logistics cost, fuel expenses for generators, consumables required
for the enrollment and the routine maintenance expenses as day to day lodging and boarding
expenses to personnel, setup expenses for the enrollment etc are un-provided.
e) Collectively these compromises result into an estimated approximate Rs. 2 Crores per every 1
Crore population enumeration totaling to approximately Rs.114/- Crores being allowed as
illegal benefits, to the service providers due to the non-enforcement by the CPSU at the cost of
Quality and Citizen convenience.

7) Is this how, blatant mistakes of estimations are corrected?
a) The CPSU constituted a committee to arrive at a baseline price, who were to evaluate all the
terms and conditions of the tender and apply the required variations and arrive at different
rates for 8 States and the identified Union Territories for the 57 Crore population.
i) This committee which was constituted on 30.12.2011 submitted its report within only one
day, which is not feasible in such short time.
ii) The AP High Court in the decision of M/s.Jyothi Computers Vs. ITI Ltd. and Others had
observed the same.
b) The baseline price thus fixed by the CPSU was in the range of Rs. 17/- plus.
c) In this connection, it's important to mention that the Chairman of the CPSU Mr. Nageshwara
Rao, upon knowing that we have filed a Writ Petition against the CPSU, had invited us for a
discussion to BEL-Factory, Bangalore on the 4th Feb'2011.
i) During such meeting and discussions, none of our queries had been clarified/
responded, however we had stumbled upon certain information which had clearly shown
that the CPSU originally arrived at Rs.24/- as the baseline price but for reasons best
known/ unknown they had reduced it arbitrarily by 30% to bring it down to Rs.17/- plus.
ii) This arbitrary reduction had not even considered the fixed and variable costs in such
application of a flat percentage of reduction.
iii) The baseline price which was so made had no logic or reasoning from its viability
perspective. This is to mean the said rate was not computed to be the lowest viable but
was approximately 30% lower than the lowest viable.
d) The hidden agenda behind such reduction can only be construed to be pre-planned to bring
down the quote process to an unreasonably/ unimaginably low and eliminate realistic quotes
and bring in the desired Service providers.
e) It is shocking to note that it is a strange coincidence for all the One District Service Providers to
fall in a very narrow band of Rs.2/- only (i.e, approximately Rs.17.15 to Rs.19.15) as these are
the favored Service Providers, whereas in the projects of similar scope floated by other
Registrars and CPSU also, the differences were in a band of Rs.40/-+
f) Subsequently for an insignificant scope change as an excuse, the CPSU made an increase of
600% to an item (from Rs.0.75/- to Rs.5.25/-) and enhanced the rate to the approximately
Rs.24/- (original baseline price visualized) resulting into approximately Rs.300 Crores.

8) Is this re-defining kick-back channels
a) The whole of the tender evaluation process in itself was a high drama as nothing was
transparent and every loophole was fully exploited by the CPSU to give maximum benefit to
their favored Service Providers. In doing so they made their best efforts and have also
succeeded in keeping the whole process completely under wraps.
b) The very purpose of having an L-Status to create a competitive bidding process and ensuring
the lowest outgo to the government is completely defeated and the state has been unduly
burdened.

c) The baseline price when applied for evaluation was not put through the formula
x*(a+0.9*b+4*c/7) as specified in the tender and a different formula x*(a+b+4*c/7), with the
factor of 0.9 for `b'-biometric component eliminated, was adopted.
i) With this the new baseline price arriving out of the new formula and further not adding
Service Tax to it but whereas adding Service Tax to the Bidders rates, were then
compared and evaluated to arrive at the L-Status, which is comparing oranges with
apples.
ii) As per the requirement of clause 17.16, firstly the L1 is to be arrived as per the formula,
invoke clause 15.15 if necessary and then the allocations are to be made as per the
clause 28.
iii) Both the approach to formula and the application of Service Tax have been violated and
such in arriving at the L1 status was in complete violation and contradicting the clauses
of the tender 15.15, 17.16 and Annexure C-2.
d) For the whole of the allocation of work/ award of contract, though definite clarity has been
provided in the Tender, all of such have conveniently been violated.
i) In the case of Swathi Smartcards Hytech Pvt. Ltd.;
(1) Has quoted for Delhi, Tamilnadu, Karnataka, Kerla, Maharashtra and Andhra Pradesh.
(2) Of which has been disqualified as below the baseline price in Delhi and in Andhra
Pradesh was Higher than the L1,2 & 3
(3) Was L1 in Kerla & Maharashtra and was Declared L1 (though not) in Tamilnadu &
Karnataka.
(4) It is learnt that in the case of Maharashtra they have been disqualified as below
baseline, where as the CPSUs unduly low price (under clause 15.15) is Rs.17.35/- and
their quoted prices is Rs.17.50/-
(5) By the application of Clause 17.07 an award of 1 centre in each of the L1 state that is 1
centre in Maharashtra, Kerla, Tamilnadu and Karnataka was to be made.
(6) After which it was to be awarded 4 more centers in Maharashtra (to total 8 as max limit)
as it was the lowest @ Rs.17.50/- in Maharashtra than for other states @ Rs.18.00/-.
(7) However such allocation changed and for some reasons unknown they have not been
awarded any centre in Maharashtra in spite of being L1 and lowest amongst all their
quotes.
(8) Rather they have been allocated 2-centers in Kerla, 2-centers in Karnataka and 4-
centers in Tamilnadu.
(9) This results into a loss of Rs.0.50/- per each enumeration in Maharashtra, totaling to
Rs. 4 Crores to the government and an undue/ illegal benefit to the bidder.
ii) Swathi Smartcards Hytech Pvt. Ltd. has received the maximum benefits from the CPSU
but is not alone to have so gained. The others who have gained equally are M/s Madras
Security Printers, M/s Eagle Software India Pvt. Ltd. and M/s India Computer
Technologies.
iii) In the case of Karnataka;
(1) Of the 13 bidders 2 have been disqualified as below the baseline price of Rs. 17.50/-.
(2) SARK Systems India Pvt. Ltd. who is L1 at Rs.19.15/- (Inclusive of Tax) has not been
awarded the work.
(3) Swiss Tech India Pvt. Ltd. who is L2 at Rs.17.96/- also has not been awarded the work.
