(8)"Intangibleproperty"includes:
(a)Creditbalances,customeroverpayments,securitydeposits,refunds,creditmemos,
unpaidwages,unusedairlineticketsandunidentifiedremittances;
(b)Stocksandotherintangibleownershipinterestsinbusinessassociations;
(c)Moneysdepositedtoredeemstocks,bonds,coupons,andothersecurities,ortomake
distributions;
(d)Amountsdueandpayableunderthetermsofinsurancepolicies;
(e)Amountsdistributedfromatrustorcustodialfundestablishedunderaplantoprovide
health,welfare,pension,vacation,severance,retirement,death,stockpurchase,profitsharing,
employeesavings,supplementalunemploymentinsuranceorsimilarbenefits;and
(f)Moneys,checks,drafts,deposits,interest,dividendsandincome.

AsusedinORS646A.276and646A.278,"giftcard"meansaprefundedrecordevidencinga
promisethattheissuerwillprovidegoodsorservicestotheowneroftherecordintheamount
shownintherecord."Giftcard"doesnotincludeprepaidtelephonecallingcards,prepaid
commercialmobileradioservicesasdefinedin47C.F.R.20.3oranygiftcardusablewithmore
thanonesellerofgoodsorservices.[2007c.7721]

ORS646A.276Saleofgiftcardthatexpires,declinesinvalue,includesfeeordoesnotgiveoptionto
redeem.
(1)Exceptasprovidedinsubsection(2)ofthissectionandORS646A.278,apersonmaynotsell
agiftcard:
(a)Thathasanexpirationdate;
(b)Thathasafacevaluethatdeclinesasaresultofthepassageoftimeorthelackof
useofthecard;
(c)Thathasafeerelatedtothecard,including,butnotlimitedto,aninactivityfee,a
maintenancefeeoraservicefee;or
(d)Thatdoesnotgivethecardholdertheoptiontoredeemthecardforcashwhenthe
facevalueofthecardhasdeclinedtoanamountlessthan$5andthecardhasbeen
usedforatleastonepurchase.Forpurposesofthisparagraph,"cash"meansmoneyor
acheck.
(2)Subsection(1)(d)ofthissectiondoesnotapplyto:
(a)Giftcardsthathavebeengivenforfreeorlessthanfullconsiderationtoapersonor
entityasadonationoraspartofapromotionaloffer;
(b)Giftcardsissuedbyanentitythatprovidesservicesthataresubjecttothefederal
CommunicationsActof1934(47U.S.C.151etseq.);and
(c)Giftcardsredeemedtoanonlineaccountforthepurchaseofgoodsorservices.
(3)Redemptionundersubsection(1)(d)ofthissectionmaybeobtainedonlyfromtheprovider
ofgoodsorservicesindicatedonthegiftcardregardlessofwhethertheprovideristheissuerof
thegiftcard.[2007c.7722;2011c.3361]

ORS646A.278Requirementsforsaleofgiftcardthatexpires.
Apersonmaysellagiftcardthathasanexpirationdateif:
(1)Thegiftcardbears,inatleast10pointtype,thewords"EXPIRESON"or"EXPIRATIONDATE"
followedbythedateonwhichthecardexpires;
(2)Thepersonsellsthegiftcardatacostbelowthefacevalueofthecard;and
(3)Thegiftcarddoesnotexpireuntilatleast30daysafterthedateofsale.[2007c.7723]
